Guarantee performance
CADstar satisfies the doctor’s warranty under the following requirements:
CADstar Quality Performance
If the product does not meet the high quality standards of CADstar – in terms of material or manufacturing defects – CADstar will replace the product for free. Similarly, if the delivered product does not conform to the manufacturing instructions, the CADstar was submitted via STAR ORDER or by order form prior to manufacturing the product.
Surgical performance
CADstar is generally not liable for the failure of an implant. However, CADstar offers a warranty from the time the CADstar product was attached to the implant along with a prosthesis. Should the implant subsequently fail, the following procedure must be adhered to in order for the guarantee to be asserted: The doctor demands in writing his claim against the company that supplied the defective implant. If this company rejects the replacement solely because a CADstar product has been used and the doctor has complied with the terms of this warranty policy, then CADstar will provide the dentist with the actual and demonstrable costs of a replacement implant and will replace the CADstar product for free.
Complaint guidelines
The dentist must comply with the following points in order to receive a performance. As soon as a defect is detected, it must be reported to CADstar within ninety (90) days in writing. In doing so, the process description of these warranty conditions must be complied with. Furthermore, the dentist contacts a CADstar sales employee or the CADstar customer service. This is where he/she can obtain a complain form as well as instructions on how to return the product.
The dentist must submit the following documents to CADstar within the ninety days described above:
- Completed complaint form including cause documentation of the complaint
- in sterilized form: the questionable CADstar product and, if necessary, the defective implant
For surgical services, the dentist must submit the following documents to CADstar within the ninety days described above:
- detailed case note stating that there were no patient contraindications and that the implants were used according to the indication
- Proof that the implant manufacturer expressly denies the guarantee only because of the use of a CADstar product
- Invoice for the implants to be replaced
In any case, the prerequisite for a service is that the dentist has paid all invoices to CADstar in full at the time of the warranty claim. In addition, all procedures involving the use of the products and implants must first be performed in accordance with (if applicable) the other implant company and, secondly, in accordance with generally accepted dental guidelines. This applies to the period before, during and after implantation.
The dentist assumes the transport costs and transport risks. If the warranty claim is justified, CADstar will cover the cost of the return.
Exclusion of warranty
CADstar exclusively assumes the warranty for the services described in these warranty conditions. Neither CADstar nor any other representatives or other third-parties that manufacture or sell products are liable whatsoever for lost earnings, compensation for damages or other consequential damage, which result from or are caused by the products.
Any claims to the CADstar warranty terms will be void if:
- the product or implant fails due to trauma, accident or other damage caused by the patient or a third party.
- the product or implant fails due to patient recognition
Contraindications with regard to a successful implant integration of inserted implants; This is especially true for diseases related to alcoholism, dependence on drugs or untreated diabetes.
- the product or implant fails due to usual wear and tear.
- the implant fails due to a detectable defect of the implant.
In principle, these terms of guarantee and the services contained therein are exhaustive and exclude all other rights, services and / or remedies. These include costs and fees in the context of laboratory work and clinical treatments.
Warranty changes
CADstar can change or suspend the warranty conditions at any time and without notice. This excludes all CADstar products that were already used prior to the change and were completely paid for by the dentist.
